Terms & Conditions

This document sets out the terms and conditions between you and Turing Festival Limited when you purchase a ticket for any event or conference organised by Turing Festival Limited (an “Event”). These terms and conditions apply to all tickets we sell for our Events. They form part of the purchase contract with Turing Festival Limited when you purchase a ticket from us for an Event. You should read this document carefully.

Who we are

We are Turing Festival Limited, a Scottish company, SC533170, which is in the main business of organising Events (such as technology conferences and gatherings). Our main Event is Turing Fest but we also run Events including, but not exclusively, under the brand names Turing Fest, Turing Founders, NextGen, Level Up by Turing Fest, Founders Dinners, Startups 101, Scottish Tech Startup Awards, and Startup Dinners.

References to “us” means Turing Festival Limited and references to “we” and “our” shall be construed accordingly.  References to “you” means the entity completing the booking request and attendees and references to “your” shall be construed accordingly.

1. CONTENT

All rights in all presentations, documentation and materials published or otherwise made available as part of an Event (including but not limited to any documentation packs or audio-visual recording of the Event) (“Content”) are owned by or licensed to us.  You shall not distribute, reproduce, modify, store, transfer or in any other way use any of the Content for commercial reasons or in any way that might infringe third party rights or that may bring us or any of our affiliates, partners, or speakers into disrepute.

 

We actively encourage tweeting, blogging, and sharing photos and videos of our Event.  

 

The Content does not necessarily reflect our views or opinions.  

 

Whilst we take care to ensure that the Content is accurate and complete, much of it is supplied by third parties and we are unable to check, and do not warrant, its accuracy or completeness.  All Content is provided on an “as is” basis without any warranties of any kind (express or implied).  We hereby exclude to the fullest extent permitted by law all liabilities, costs, claims, damages, losses and/or expenses arising from any inaccuracy or omission in the Content or arising from any infringing, defamatory, or otherwise unlawful material in the Content.  

 

To the extent that any Content is made available by us online, we reserve the right to suspend or remove access to such Content at any time.

 

We reserve the right to change speakers for an Event at any time.  

2. TICKETS

Ticket prices will be clearly marked on the ticketing site.  

 

Startup tickets

 

Tickets will be available at two prices: one for founders of and employees of startups, and one for the general public. Ticket purchasers may purchase the ticket at the price that is relevant for their situation on the honour system.  In the event of a purchase at the discounted startup ticket price by someone who is not a founder of or employee of a startup, we reserve the right to cancel the ticket purchase and refund the payment price, minus any discounts and processing fees.  The definition of a startup is available on the ticket purchase page. Freelancers may choose to purchase a Startup ticket. 

 

It is as follows:

 

Startup tickets are for early stage organisations that fit the following criteria:

  • Less than 6 years old
  • Fewer than 150 employees
  • Have raised less than £100m in investment
  • Have less than £50m in revenue
  • Privately held 

 

General tickets are for everyone else.  

Invoicing 

 

We will only offer payment by invoice for 5 tickets or more due to administrative overhead involved. 

 

If you are paying by invoice, payment is due within 14 days of invoicing. Ticket prices will only be honoured for the 14 day period stated on the invoice.  After that period, ticket prices will increase to the price clearly marked on the ticketing site, if that price is higher than the invoiced price. 

 

Tickets will only be issued upon full payment, and are subject to availability.

Reselling

 

You cannot resell a ticket.  This includes tickets purchased at any price point, or allocated through a sponsorship.  Doing so will void the ticket and neither the ticket’s original purchaser or the subsequent ticket holder will gain entry to the event, and no refund will be issued to either party.

Ticket assignment

 

All tickets must be assigned to an attendee, and all attendee details must be 100% complete within 30 days of receipt of your ticket.  This includes name, job title, company name, and email.

Free and subsidised tickets

 

In certain cases, free or subsidised tickets may be offered within 30 days of the event start date.  In these instances, tickets must be assigned within 7 days of receipt of your ticket in accordance with the details provided in the above paragraph.  

 

If you have secured a free or subsidised ticket but have already bought a ticket, you are not eligible for a refund.

3. MARKETING

By purchasing a ticket, registering a ticket, or attending any of our events you acknowledge and accept that we have the right to publicly announce our business relationship with you and your company which shall include but not be limited to announcements on social media. Such announcements shall not be disparaging or otherwise adverse to your business.

 

You grant us the right to use any photography, video, or screen capture from the event which may capture your image and any quotes on feedback forms for the future marketing of events, within the boundaries set by our privacy policy and your rights as set out in Clause 5. Such coverage shall not be disparaging or otherwise adverse to you or your business.

4. ACCESSIBILITY

We endeavour to make our conferences and events accessible to all.  If you have special access requirements please contact us when you register and we will work to best accommodate you.  

5. PRIVACY POLICY

 

Our privacy policy can be found at https://turingfest.com/privacy-policy/. By purchasing a ticket, registering a ticket, or attending any of our events you agree to our treatment of your data – specifically as it pertains to our legitimate interests and contractual obligation to you in delivering the event – while still retaining the rights to object to our use of your data, the right to have your data corrected, and the right to review all data we hold in relation to you as an attendee.

6. TICKET POLICY

Refunds

All purchases of tickets for conferences and events are non-refundable in their entirety. 

Transfer, resale, and cancellation

The tickets purchased are non-transferrable; they are for your own personal use or that of your business only, for the event indicated.  Tickets may not be resold or transferred under any circumstances, including but not limited to use as part of any promotion or competition. Tickets can only be reassigned to another attendee in accordance with this policy as stated below. 

 

Where there has been any resale or attempted resale of any tickets (or any other breach of this term), we reserve the right to deny entry using the affected tickets with immediate effect, and the ticket price shall be forfeit. 

 

We reserve the right to cancel any ticket purchase made by any person or body whom we reasonably believe to be associated with any ticket broker or tout.

Replacement of lost, stolen, or damaged tickets or passes 

We will not be responsible for replacement of any tickets that are lost or stolen. 

Ticket reassignment

Reassignment of tickets from one attendee to another will be permitted by emailing to events@turingfest.com or via the website free of charge up to 7 days prior to the commencement of the event. No reassignments will be allowed after 7 days prior to the commencement of the event.

 

Some of our Events may be multi-day events.  Tickets for multi-day events can only be used by the registered attendee and cannot be reassigned after 7 days prior to the commencement of the first day of the event.  

 

For the avoidance of doubt: multi-day tickets are for the use of one attendee only and cannot be shared by more than one attendee over the course of the event.  Any attempt to do so will result in the ticket being revoked, access will be denied, and the ticket price will be forfeit.

Code of Conduct

We reserve the right to refuse or revoke admission to any event or conference for any breach of these Terms and Conditions, or for breach of our Code of Conduct (available on our website).  In the event we refuse or revoke admission to any event or conference due to a breach by the attendee, the ticket purchase price will be forfeit. 

7. EVENT CANCELLATION, POSTPONEMENT & SUBSTITUTION POLICY

We are not responsible for any loss or damage as a result of a substitution, alteration, cancellation, amendment or postponement of an event. 

 

We shall assume no liability whatsoever in the circumstances that an event is cancelled, rescheduled or postponed due to any event beyond our reasonable control including war, fire, labour strike, extreme weather, pandemic, terrorist threats or other emergency.

Cancelled events and conferences 

In the unlikely circumstances that we cancel a conference or event, our liability is limited to the share of paid registration fees that remains after credit card and payment processing fees have been incurred and deducted. 

 

In the case that we cancel an event or conference, we will offer the purchaser of record a refund of the purchase price paid, minus any processing fees. 

Postponed events and conferences

If our Event is postponed to a future date, all ticket holders will be notified of the amended dates and details via email and via the event website.

 

If you are unable to attend on the amended dates, you can:

  • reassign your ticket to another person via the event website, or 
  • exchange the ticket for a credit for a future Turing Festival Limited conference or event, up to the value of the amount paid, minus any discounts, for the original ticket (subject to availability).

Event alterations and substitutions

While the format, speakers, topics for events are confirmed at the time of publishing, circumstances beyond the control of the organisers may necessitate substitutions, alterations or cancellations. As such, we reserve the right to alter or modify the advertised event format, speakers, venue, and topics if necessary without any liability to you whatsoever. Any substitutions or alterations will be updated on our website as soon as practical.

Event Changes due to COVID-19 

In light of the ongoing global COVID-19 pandemic, we may need to make changes to event dates, venues, formats, or to other aspects of the event in order to protect the safety of our attendees, speakers, partners, and team members.  We will notify attendees of any significant changes as soon as practical.  

 

In the event of a change of dates or format due to COVID-19, all ticket holders will be notified of the amended dates and details via email and via the event website.

 

If the attendee is unable or unwilling to attend on the amended dates, or unable or unwilling to attend an event with an amended format, the attendee can:

  • reassign their ticket to another person via the event website, or 
  • exchange the ticket for a credit for a future Turing Festival Limited conference or event, up to the value of the amount paid, minus any discounts, for the original ticket (subject to availability). Tickets purchased as part of a bundle will be credited for the amount paid for the ticket, not for the amount paid for the entire bundle.

9. TICKET DELIVERY

Once a successful purchase transaction has been completed, tickets are delivered in electronic soft-copy via email to the email address nominated by the purchaser. For some ticket types it may be necessary to complete required information — such as attendee name — before the tickets can be issued. The ticket acts as a receipt for the transaction and can be used to redeem entry at the event listed on the ticket. A printed hard-copy ticket or an electronic soft-copy ticket detailing the reference number can be used to register at the event. 

10. VISA REQUIREMENTS

It is your sole responsibility to take care of visa requirements. If you require an entry visa to attend, volunteer or exhibit at the Conference, you must allow sufficient time for the visa application procedure.

 

In the event you are not granted a visa, we are under no obligation to refund your ticket unless you are eligible under applicable law to avail of a right to cancel your purchase of a ticket within 14 days of the day the contract for distance selling was concluded.

11. GENERAL CLAUSES

  1. We shall be entitled to delegate the duties provision of our obligations under this Terms and Conditions.
  2. No other terms shall apply to these Terms and Conditions and this document contains the entire terms and conditions and understanding between us in respect of all matters which are referred to herein and supersede any prior, written or oral agreement between us relating to such matters. You confirm that in agreeing to accept these terms you have not relied on any representation that is not expressly included herein and you agree that you shall have no remedy in respect of any misrepresentation which has not become a part of these terms. However, nothing in these terms purport to exclude liability for any fraudulent statement or act.
  3. If any part of the terms herein shall be deemed unlawful, void or for any reason unenforceable then that provision shall be deemed to be severable from these terms and shall not affect the validity and enforceability of any of the remaining provisions of the terms.

12. LIMITATION OF LIABILITY

 

Our aggregate liability to you, whether such liability arises in contract, delict (including negligence) or otherwise, for any damages, loss, costs, claims or expenses of any kind howsoever arising, out of in connection with any booking (or requested booking) made by you or otherwise in relation to a conference or event, shall be limited to the price paid by you in respect for your booking to attend the conference.

 

We shall not be liable to you for (i) any loss of profit, loss of or damage to data, loss of anticipated savings or interest, loss of or damage to reputation or goodwill or (ii) any indirect, special or consequential damages, loss, costs, claims or expenses of any kind.  

You agree to indemnify us, our staff and our affiliates and to hold us harmless to the fullest extent permitted by law, against all loss, costs, claims or expenses of any kind arising from any act or omission by you (including your delegates) during or otherwise in relation to a conference.

 

Nothing in these Terms and Conditions shall limit or exclude either party’s liability for death or personal injury caused by that party’s negligence, or the negligence of that party’s employees, agents, or subcontractors; fraud or fraudulent misrepresentation; or any other liability which cannot be limited or excluded by applicable law.  

13. INDEMNITY

You agree to be fully responsible for (and fully indemnify us against) all claims, liability, damages, losses, costs and expenses, including legal fees, suffered by us and arising out of any breach of these terms and conditions by you or any other liabilities incurred by us arising out of your use of the website, or use by any other person accessing the website using your computer or internet access account.

14. INTELLECTUAL PROPERTY AND RIGHT TO USE

You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all material or content contained within the website shall remain at all times owned by us or as stated in Clause 5. You are permitted to use this material only as expressly authorised by us.

 

We reserve all rights not expressly granted in and to the website and the Content in the website. 

15. LAW AND JURISDICTION

Scots law governs these terms and conditions and any disputes are subject to the exclusive jurisdiction of the Scottish Courts.
